Pre-Nuptial Agreements

I am constantly asked “should I have a prenuptial agreement?”. The answer is it depends on your specific situation and goals. Prenuptial agreements are valid in Michigan and both parties should be educated as to the consequence of signing such an agreement. Typically the agreement will address the division of assets upon divorce or death. The agreement should always be coordinated with your estate planning documents. The agreement may provide for the payment of spousal support or alimony. Those especially vulnerable to not having a prenuptial agreement are those individuals that are business owners, have children from a prior marriage, are entering the marriage with assets of their own and those individuals expecting an inheritance.
